What to look for in compliance deadlines

Effective date versus compliance date

The effective date is when a rule becomes binding; a compliance date is when covered entities must actually meet its requirements. Many rules set the two apart, so ask for both.

Phased or tiered timing

Regulations sometimes give smaller organizations, or certain obligations, more time. Check which tier you fall in by reading the definitions the phase-in depends on.

Event-triggered deadlines

Some deadlines start when something happens, such as an incident, a change of ownership or the end of a reporting period, and are counted from it. Read how the period is counted, including whether the rule says anything about business or calendar days.

Where dates hide

Dates may sit in a transition section, an applicability section, a table in an appendix or the explanatory statement rather than the main requirements. A direct question about dates can reach them wherever they are written; check each citation.

What is a compliance deadline?

A compliance deadline is the point in time by which an organization covered by a regulation must meet a specific requirement, whether that is a single fixed date, a period counted from an event or a recurring due date.

An effective date is not always a compliance deadline. A rule can be in force from its effective date while giving covered organizations until a later compliance date, or a phased series of dates, to meet its requirements.
