Read the renewal option before its deadline passes

A renewal option gives a tenant the right to extend the lease for a further term, but usually only if written notice reaches the landlord inside a set window. Miss that window and the right can lapse. How to find renewal terms with Search+

What to look for in a renewal option

The value of a renewal option lies in its detail. Check these points well before the window opens.

Notice window and method

Options commonly set an earliest and latest date for notice, measured back from the expiry date, and require notice in writing to a stated address. The notices clause may add delivery rules.

Conditions on exercise

Many options apply only if the tenant is not in default, is still occupying the premises, or is the original tenant. Some options cannot pass to an assignee or subtenant.

How renewal rent is set

Renewal rent may be a fixed amount, a stated increase over the last rent, or fair market rent agreed between the parties or set by an appraisal process. Market rent mechanisms often include a floor.

Interaction with other rights

What is a renewal option in a lease?

A renewal option is a right, usually held by the tenant, to extend a lease for one or more additional terms after the original term ends, by giving notice within a set period and on the rent and conditions the lease specifies.

It is not the same as automatic renewal, where a lease rolls over unless someone gives notice to stop it, and it differs from holding over, where a tenant stays after expiry without any new term being agreed.
