How to find early termination terms with Search+

    Break rights are often added or removed in later amendments or side letters. Put the lease and those documents in the same workspace so an answer reflects the terms that apply now.

  2. Ask about each way the lease can end

    Ask separately about a tenant break option, a landlord termination right, termination on sale or redevelopment, and what happens after damage to the premises. Each one usually has its own notice period and conditions.

  3. Check the conditions and the follow-on clauses

    Open the cited text, then ask about the clauses it depends on: the notices section, the surrender and restoration duties, and any fee calculation. A break right that misses one condition may not work.

What to look for in an early termination clause

Break rights are valuable and fragile. One missed condition can defeat a break, so read the conditions as carefully as the right itself.

Who holds the right

A break option may belong to the tenant, the landlord or both. Check whose right it is and whether it is personal to the original tenant, which can matter after an assignment.

Fixed dates and notice windows

Many break rights can be used only on a stated date or anniversary, with written notice served within a window before it. Missing the window can mean waiting for the next date or losing the right.

Fees and repayments

Commercial leases often attach a termination fee, sometimes linked to costs the landlord has not yet recovered, such as an improvement allowance or commissions. Ask how the figure is worked out.

Residential differences

Residential leases may set a fee or require rent until the unit is re-let, and some jurisdictions give tenants specific rights to end a lease in certain situations. The rules vary by place, so check local law as well as the lease.

What is early termination in a lease?

Early termination in a lease means ending it before its stated expiry date under a right the lease grants, often called a break clause or termination option, usually on conditions such as advance written notice, a fee or being up to date with rent.

It is not the same as termination for default, where a landlord ends the lease because the tenant breached it, and it differs from a surrender, where both sides agree to end the lease on negotiated terms.

Early termination questions
