HOA DOCUMENTS DETAILS

Check your HOA's pet rules before you move in with a pet

Pet rules can come from the declaration, from rules the board adopts later, or from both, and they cover more than the number of animals: size or breed limits, leash and waste rules, nuisance standards and what the board can do after complaints. Ask Search+ what your association's documents say about pets and open each cited provision to see which document it comes from and whether an amendment changed it.

How to check pet rules with Search+

  1. Upload the declaration, rules and amendments

Add the governing documents, the current rules and regulations and any amendments. Pet limits are often in the rules rather than the declaration.

  2. Describe your pets

In Workspace Context, write the facts that matter, such as "Two dogs, one large breed, plus a cat; we may foster." Each answer takes that into account.

  3. Ask about limits, conduct and enforcement

Ask about number and type limits first, then leash, waste and noise rules, then the enforcement process. Open each citation.

Questions about HOA pet rules

How many pets may an owner keep, and does the limit differ for dogs and cats?

Size and breed

Are there weight or breed restrictions for dogs?

Common areas

Must pets be leashed in common areas, and are any areas off limits to pets?

Enforcement

What can the board do if an owner's pet violates the rules, and is there a hearing first?

What to look for in HOA pet rules

Where the rule lives

A pet limit in the declaration is harder to change than one in board rules. The citation tells you which document holds it.

Grandfathering

When rules tighten, existing pets are sometimes allowed to stay. Look for wording about pets already in residence.

Assistance animals are treated differently

Laws on assistance and service animals can override pet restrictions. How they apply depends on the law where you live, not only on the HOA documents.

Nuisance standards

Many documents ban pets that cause a nuisance without defining it precisely, which leaves room for board judgment.

Cited wording

Search+ cites each provision it uses and does not invent section numbers the documents lack, so you can read the exact rule.

What are HOA pet rules?

HOA pet rules are the restrictions in an association's governing documents and rules on the number, type and behavior of pets kept on a property and in common areas.

A lease's pet clause applies between a landlord and a tenant. HOA pet rules bind owners, and usually their tenants, under the association's documents.

HOA pet rule questions

Can Search+ tell me how many pets my HOA allows?
Ask about the pet limit and the answer cites the provision that sets it, whether in the declaration or the rules.
Will it tell me if a rule was amended?
Upload the amendments with the original documents and ask whether pet provisions have changed. The answer cites the original and the amendment.
Does it cover what happens after a complaint?
Ask about enforcement and fines for pet violations. The answer cites the process the documents describe.
Can it tell me if my assistance animal is allowed?
It can show what your HOA documents say. Rules for assistance animals also depend on law that the documents may not contain, so check with the association or a lawyer.
Is this legal advice about pets in my HOA?
No. Search+ helps you find and read the pet provisions. It is not legal advice, so confirm anything important with the association.
